Public Terms of Service

1 Acceptance & eligibility

By accessing or using apkishop.com you confirm that you are at least 18 years old (or the age of majority where you live) and able to form a binding contract. If you use ApKiShop on behalf of a business, you confirm you are authorised to bind that business to these Terms. If you do not agree, please do not use the platform.

When you select the registration checkbox and submit the form, you provide your electronic signature and expressly agree to these Terms and our Privacy Policy. We may retain reasonable electronic records of that acceptance, including the date, time, account, Terms version and technical request data, as evidence of the agreement and for legal, security and audit purposes.

2 Definitions

• Platform — the apkishop.com website and related ApKiShop services.
• Vendor — a business or individual operating a subscription store on the Platform.
• Home User — an individual who posts a free advertisement without a paid store.
• Buyer — a user who purchases or enquires about goods or services listed on the Platform.
• Subscription — a recurring paid plan that entitles a Vendor to operate a store and access related features.
• Listing / Advertisement — any product, service or classified posting published on the Platform.

3 Accounts & verification

You must provide accurate, current and complete information when registering and keep it up to date. You are responsible for safeguarding your password and for all activity under your account. Vendors and certain users may be required to complete identity or business verification (KYC) before publishing certain Listings or operating a store; we may refuse, suspend or limit access where verification fails or where we reasonably suspect fraud or misuse. Notify us immediately of any unauthorised use of your account.

An account is a limited, personal, revocable permission to use the Platform. It is not property and may not be sold, transferred, rented or shared without our written permission. You must not bypass security or platform controls, scrape the Platform, introduce malicious code, manipulate rankings or reviews, interfere with another user, or use automated access except through an interface we expressly approve.

4 Marketplace model & plans

ApKiShop offers different ways to participate:

We may introduce, change, or discontinue plans and features, and adjust pricing prospectively. We will give reasonable notice of material changes that affect an active paid Subscription.

To the fullest extent permitted by law, we may determine how the Platform is presented and operated, set or change listing limits and eligibility criteria, test features, refuse service, and remove, re-rank or restrict content or functionality. No feature, search position, audience reach, sales volume or uninterrupted availability is guaranteed.

5 Cottage-industry discount (women-led, home-based)

To support financial inclusion and women's entrepreneurship, ApKiShop offers a 50% discount on Vendor subscriptions to eligible women who operate home-based or cottage-industry businesses.

• Eligibility is assessed in good faith based on the information and any supporting documents you provide.
• The discount applies to qualifying subscription fees only and cannot be combined with other offers unless we state otherwise.
• We may verify eligibility at any time and may pause, withdraw or recover the discount if the information provided is inaccurate, the account no longer qualifies, or the programme is abused.
• We may set fair limits on the programme and update its terms prospectively to keep it sustainable and fair to all participants.

This discount is a voluntary benefit offered by ApKiShop and does not create any entitlement beyond the period for which it is granted.

6 Subscriptions, billing, renewals & refunds

• Subscriptions are billed in advance on a recurring basis and, where applicable, renew automatically until cancelled.
• You authorise us and our payment partners to charge the applicable fees, taxes and any discounted amounts to your chosen payment method.
• You can cancel renewal at any time before the next billing date; cancellation takes effect at the end of the current paid period.
• Prices may be exclusive of taxes, which are added where required by law.
• Except where required by applicable consumer-protection law, subscription fees are generally non-refundable for partial periods. Any specific refund entitlements are set out in our refund practices and the law of your jurisdiction.

Card and payment details used to pay ApKiShop subscription fees are handled by our payment processors under their own terms; ApKiShop does not store full card numbers. This billing service does not process product-sale payments between buyers and sellers.

7 Listings, advertisements & prohibited content

You are solely responsible for the content you publish and must have the right to sell what you list. Listings must be accurate, lawful and not misleading. You must not post, sell or advertise:

• illegal, counterfeit, stolen, recalled or unsafe goods;
• weapons, drugs, regulated or restricted items where you lack authorisation;
• content that infringes intellectual-property or privacy rights;
• adult, hateful, fraudulent, or deceptive content; or
• anything that violates applicable law or these Terms.

We may review, refuse, edit, re-categorise, or remove any Listing, and suspend accounts that breach these rules, to keep the marketplace safe and trustworthy.

8 Our role as an intermediary

ApKiShop provides subscription storefronts, listing, discovery, moderation and seller-contact tools. We are not a party to the contract of sale between a Buyer and a Vendor or Home User, and we are not the seller or merchant of record for listed products. We do not manufacture, inspect, own, store or deliver the goods, and we do not guarantee the quality, safety, legality or accuracy of any Listing.

Sellers own or control their inventory, set their prices and descriptions, respond to buyers, and handle product payment, fulfilment, delivery, returns, warranties and sale disputes. Buyers and sellers arrange those matters directly. ApKiShop does not provide checkout for product sales and does not receive, hold, settle or distribute buyer-to-seller product-sale proceeds.

9 Intellectual property

The Platform, including its software, design, logos and content created by ApKiShop, is owned by ApKiShop or its licensors and protected by intellectual-property laws. You may not copy, modify, distribute or create derivative works from it without permission. You retain ownership of the content you submit, but you grant ApKiShop a worldwide, non-exclusive, transferable, sublicensable, royalty-free licence to host, store, reproduce, adapt, translate, format, distribute, publicly display, communicate and promote that content in any media for operating, improving, securing and marketing the Platform and its listings. This licence continues for as long as reasonably necessary for backups, legal compliance, dispute resolution and content already shared through the Platform. You warrant that you have all rights needed to grant this licence.

10 Reviews & user content

Reviews and other user content must be honest, lawful and your own. We may moderate, remove or refuse content that is fake, abusive, defamatory, or that breaches these Terms. You are responsible for the content you post and the consequences of posting it.

11 Disclaimers & limitation of liability

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, ApKiShop disclaims all express, implied and statutory warranties, including merchantability, fitness for a particular purpose, title and non-infringement. We are not liable for indirect, incidental, special, exemplary, punitive or consequential losses, or for loss of profits, revenue, opportunity, data or goodwill, arising from the Platform or any transaction with another user, even if advised that such loss was possible. Where liability cannot be excluded, our total aggregate liability for all claims arising from the same events is limited to the amount you paid ApKiShop in the three months before the event giving rise to the claim. Nothing in these Terms excludes or limits liability, or a statutory consumer right, that applicable law does not permit us to exclude or limit.

12 Indemnification

To the fullest extent permitted by law, you will defend, indemnify and hold harmless ApKiShop, its affiliates, and their officers, directors, employees, contractors and agents from third-party claims, liabilities, losses, penalties, damages and reasonable legal costs arising from your breach of these Terms, your Listings or content, your products or services, your taxes, your transactions with other users, or your violation of law or a third-party right. We may control the defence and settlement of an indemnified claim, and you will provide reasonable cooperation. You may not settle a claim in a way that admits fault by or imposes an obligation on an indemnified party without our written consent.

13 Suspension & termination

You may stop using ApKiShop at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, fail to pay an amount due, create risk or legal exposure, harm the Platform or another user, remain inactive, or where required by law. We may preserve, withhold or disclose account information and content where reasonably necessary for fraud prevention, enforcement, dispute resolution or legal compliance. On termination, your right to use the Platform ends; provisions that by their nature should survive (including payment obligations, licences, ownership, disclaimers, liability limits, indemnity and dispute terms) will continue to apply.

14 Governing law & dispute resolution

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict- of-law rules, and the courts of Lahore, Pakistan have jurisdiction, except where mandatory local consumer law grants you the protection of your home jurisdiction. Before starting formal proceedings, you agree to first contact us to seek an amicable resolution in good faith. Consumers retain all mandatory rights and remedies available under the law of their place of residence.

15 Changes & how to contact us

We may update these Terms from time to time. We will post the updated version here with a new "Last updated" date and, where changes are material, give additional notice. Your continued use of ApKiShop after an update means you accept the revised Terms.
